  • Location information, including your zip code (optional) during sign-up and your address at the time of purchase. While we track IP addresses, they are not a reliable source of location information. Primarily, we use self-reported zip codes to determine USDA growing zones, allowing us to provide relevant content and regional product suggestions. This information may also include precise location data provided by a mobile or other device accessing our Websites or associated with your IP address or other online or device identifiers.
  • Activity, usage, viewing, technical, and device data when you visit our Websites, or open emails we send. This includes the content you view, how often you use our Websites, your browser or device type, unique device identifier, and IP address. We may obtain this information from a third party, such as a site or platform provider.
  • Copies of your Communications, including call recordings when you call our customer service lines.

  • Directly From You. We collect information you provide to us when you request or purchase products, services, or information from us, register with us, submit or post User Uploads, respond to surveys, call our customer service phone number(s), or otherwise interact with us using one or more devices.

Interactions on our posts do not provide us access to your email address, real name, browsing history, or preferences.

Automatic Technologies We Use

The technologies we use for this automatic data collection include, but are not limited to:

  1. Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Website. KVITER utilizes third-party payment processors to collect and process your payment for our Products. We may use a variety of third parties to facilitate our payments, such as Amazon, Stripe, and PayPal. Data Security, Integrity, and Retention

The security, integrity, and confidentiality of your information are very important to us. We have implemented technical, administrative, and physical security measures that are designed to protect your information from unauthorized access, disclosure, use, and modification. We regularly review our security procedures to consider appropriate new technology and methods. 

As part of our commitment to safeguarding your privacy, we are implementing server-side tracking. This means that instead of relying on third-party scripts and cookies that run on your device, we process data directly on our secure servers. Server-side tracking enhances your privacy by reducing the exposure of your information to potential vulnerabilities on your device and limiting third-party access. Children Under the Age of 18

Our Services are not for children. No one under 18 is permitted to provide any information on our Websites. We do not knowingly collect information from children. KVITER LLC U.S. STATE PRIVACY RIGHTS

This Privacy Notice for U.S. Residents (this “Notice”) supplements the information contained in the KVITER LLC (“Company,” “we,” or “us”) Privacy Policy and applies solely to residents of certain U.S. states that have their own data privacy laws and regulations, and associated rights. Please read this Notice in conjunction with our Privacy Policy.

CALIFORNIA

We adopt this section of this Notice to comply with the required “Notice at Collection” disclosures under the California Consumer Privacy Act of 2018 (the “CCPA”), as amended by the California Privacy Rights Act of 2020 (the “CPRA”) (together, the “California Privacy Laws”). This section applies to California consumers, including employees, job applicants, and contractors (“you”). Any terms defined in the California Privacy Laws have the same meaning when used in this section of this Notice.

Selling and Sharing of Personal Information

We do not rent or sell the personal information we collected. However, certain data collection on our websites for purposes of interest-based advertising and social media tools may be a “sharing” under the California Privacy Laws. As defined by California Privacy Laws, we have “shared” certain data elements with our advertising, marketing, and audience measurement service providers for “targeting advertising” as described in the Online Tracking Technologies and Advertising section in our Privacy Policy. The shared data falls within the following categories of personal information:

  • Internet or other electronic network activity information, namely, website activity such as browsing history and time spent.

Data Retention

We retain each category of personal information that we collect for as long as necessary to fulfill the purposes described in our Privacy Policy, including to satisfy legal or reporting requirements. What this means in practice will vary for different types of information, but the criteria assessed in the data retention analysis consider ongoing business or legal needs for the information, for example in relation to tax, health and safety, and potential or actual disputes or investigations.

Your California Privacy Rights

If you are a California resident, you can make certain requests regarding your personal information. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies.   • Right to Opt-Out of Sale or Sharing of Personal Information: You have the right to “opt out” of the “sale” or “sharing” of your “personal information” to or with “third parties” (as those terms are defined by California Privacy Laws).
  • Right Not to Receive Discriminatory Treatment. You have the right not to receive discriminatory treatment for the exercise of your privacy rights. If you choose to exercise any of these rights, you will not receive different prices or quality of services unless permitted by applicable law, including if those differences are reasonably related to your information. For example, if you exercise your right to opt out of “sale” or “sharing” of your “personal information,” the ads you view may not be tailored to your interests. However, we may offer you certain financial incentives permitted by the California Privacy Laws that can result in different prices, rates, or quality levels. Any California Privacy Laws-permitted financial incentive we offer will reasonably relate to your personal information’s value. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time. Exercising Your California Privacy Rights

  • Making Requests to Know, Access, Delete, or Correct Your Personal Information. To exercise your rights to know, access, delete, or correct your personal information, please submit a request by emailing us at hello@kviterseeds.com, calling us at 844-4-KVITER, or contacting us here. Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You may only submit a request to know twice within a 12-month period. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a request to review and comply with the request. You do not need to create an account with us to submit a request to know or delete. We endeavor to substantively respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We will delete or de-identify personal information not subject to a legal exception from our records and will direct our service providers to take similar action. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.
  • Instructions for Using an Authorized Agent to Make Requests: You may use an authorized agent to submit a request to know or an access, deletion, correction, or opt-out request on your behalf. An authorized agent must have your signed permission to submit a request on your behalf or provide proof that they have power of attorney in accordance with applicable law. Before completing requests from authorized agents, we may contact you directly to confirm you’ve given your permission and/or to verify your identity. Notice Of Financial Incentives

We may provide special offers or discounts to you as part of certain programs, promotional campaigns, subscriptions, or other offerings. We may also provide discounts when you sign up to receive marketing messages or when you claim a specific offer. In this Notice of Financial Incentives, we refer to these various programs and offerings as the “Programs.”

In general, we collect personal information to support and fulfill the Programs, which could include identifiers, Internet or other electronic network activity information, geolocation data, and inferences drawn from the above. Because we collect personal information, the Programs may be considered to be “financial incentives” or “price or service differences” under California law.

NEVADA

Nevada’s privacy law, known as Senate Bill 220, provides Nevada residents with a limited right to opt-out of certain personal information sales. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

TEXAS

We adopt this section of this Notice to give Texas residents (“you”) additional information required by the Texas Data Privacy and Security Act (the “TXDPSA”). This section applies to you when you are acting in an individual or household context, but not when you are acting in a commercial or employment context, including as a job applicant. Any terms defined in the TXDPSA have the same meaning when used in this section of this Notice.

Collection, Use, and Sharing of Your Personal Data

We do not rent or sell the personal information we collected. We may disclose your personal information to our third-party service providers for a business purpose as described in the How We Share Your Information section in our Privacy Policy. This includes sharing information with our advertising, marketing, and audience measurement service providers for “targeted advertising”, as described in the Online Tracking Technologies and Advertising section in our Privacy Policy. We do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning consumers, as defined in the TXDPSA. We do not knowingly process personal data from children under the age of 13. Exercising Your Texas Privacy Rights

  • Making Requests to Know, Access, or Delete Your Personal Information. To exercise your rights to know, access, delete, or correct your personal data, please submit a request by emailing us at hello@kviterseeds.com, calling us at 844-4-KVITER 844-4-KVITER, or contacting us here. Only you, or someone legally authorized to act on your behalf, may make a request related to your personal data. We cannot respond to your request or provide you with personal data if we cannot verify your identity or authority to make the request and confirm the personal data relates to you. We will only use personal data provided in a request to review and comply with the request. You do not need to create an account with us to submit a request to know or delete. We endeavor to substantively respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We will delete or de-identify personal data not subject to a legal exception from our records and will direct our service providers to take similar action. For data portability requests, we will select a format to provide your personal data that is readily usable and should allow you to transmit the data from one entity to another entity without hindrance.
  • Instructions for Using an Authorized Agent to Make Requests: You may use an authorized agent to submit a request to know or an access, deletion, correction, or opt-out request on your behalf. An authorized agent must have your signed permission to submit a request on your behalf or provide proof that they have power of attorney in accordance with applicable law. Before completing requests from authorized agents, we may contact you directly to confirm you’ve given your permission and/or to verify your identity.
